The following other forms will assist you in bankruptcy or bankruptcy related processes.


Application to become Bankrupt – Also known as a ‘Debtor’s Petition’. Includes information, instructions, and a ‘Statement of Affairs’. Link

Declaration of intention to prsent a Debtor’s Petition – While not strictly necessary, a Declaration of Intention prevents unsecured creditors, the bailiff or sheriff from taking action to recover debts for a period of 7 days. If you decide after the end of 7 days not to petition for bankruptcy, and you have not otherwise come to a settlement with your creditors, a creditor can use the fact that you have presented this Declaration to apply to a Court to make you bankrupt. Statement of Affairs – You’ll need to fill one of these out if you become bankrupt under a sequestration order, i.e. a creditor files for your bankruptcy. Link

Prescribed Information for proposing a Debt Agreement – You need to print and sign one of these if you are proposing a Debt Agreement with your creditors. Note that ITSA strongly recommends that you get the assistance of a financial counsellor, debt agreement administrator, or registered trustee when proposing a formal debt agreement. Link
